The following Insurance FAQs were prepared in partnership with BMS Canada Risk Services Ltd. (BMS). PLI protects you against liability or allegations of liability for injury or damages that have resulted from a negligent act, error, or omission that has arisen out of your professional capacity as a Family Mediator.

It protects Mediators by ensuring that your legal defense is coordinated and paid for if a claim is made against you, and also covers the cost of client compensation or damages.

While PLI provides coverage for the rendering or failure to render professional services, CGL provides coverage for non-professional service exposures, such as claims involving bodily injury and property damage that has been caused by your operations and/or premises.

For example, if a client slips and injures themselves in your office, they may look to hold you and/or your business accountable for the damages.

The Professional Liability Insurance has a Worldwide territorial limit excluding the USA and responds to claims brought against you within Canada. For coverage to apply, you must follow the required professional rules or regulations where you are delivering your services and where your client is located. You must also determine if there are any requirements where you are delivering your service and where your client is located.

It is not the role and responsibility of an insurance broker of an insurance company to define “family mediation”. At all times, the ultimate definition comes from FMC. If you are unsure if what you are doing is considered “family mediation”, then you should verify this with Family Mediation Canada.
